Fooled by Crunchberries
This case sounded so stupid to me that at first I thought it had to be a joke, but here's the actual ruling, Sugawara v. PepsiCo, Inc., so apparently it's true.Janine Sugawara filed suit against PepsiCo, maker of Cap'n Crunch's CrunchBerries, alleging she had been deceived by their marketing into believing that crunchberries were real fruit, only to learn, to her dismay, that the product contained "no berries of any kind."
The judge threw the case out, noting, "The survival of the instant claim would require this Court to ignore all concepts of personal responsibility and common sense."
Sugawara is a serial litigant (pun intended). She had previously filed suit against the maker of Froot Loops for similar reasons. Link: Lowering the Bar

This is insane. I cannot believe that some woman would try to sue saying that she thinks crunch berries are real fruit. This is a much further stretch than anything I have ever heard and the lawyer that took the case should be hung.

Grape Nuts had better beware. Grape Nuts cereal contains neither grapes nor nuts.
Then there's Frankenberry ceareal ... oh, wait, maybe it really does contain frankenberries.
I'm thinking of suing the makers of Lucky Charms, because as far as I can tell, the charms in that cereal aren't all that lucky.

The cereal makers should now sue her and her attorneys for the costs incurred in defending this nonsense.
A few more of those kind of fees might discourage stupid people from filing stupid lawsuits. But I doubt it....

This kind of innanity seems to come up with monotonous regularity. And it isn't always handled so sensibly.
Such as the manufacturer of "Welsh Dragon" sausages who was told to withdraw them from sale by the Trading Standards Institute because they didn't contain actual dragon.

I must admit to being very disappointed by popcorn chicken, I was expecting a crispy crunch bite with my chicken. It never struck me that I should sue though.
