A judge clearing out her office before retirement finds a 15-year-old ruling that she forgot to issue
“Everyone thought it was all done” said Judge Evelyn Baker of St Louis, Missouri of the case of Senu-Oke v Modern Moving Systems Inc.
The case involved a college teacher, Edward Senu-Oke, who sued his moving company over a disastrous move from Wyoming to Wisconsin in 1993. Judge Baker found for Mr. Senu-Oke in 2002 never got round to issuing a formal ruling, so the case sat in a file for six years until it was discovered when the judge started clearing out her office prior to retirement. The delay came about when the defendants’ lawyer did not reply to a letter from the judge’s office, and neither the office nor the claimant’s lawyer noticed or investigated the hold-up.
However, Baker must have gone some way to making it up to the claimant when she decided to award $1.5 million in damages, though the defendants have since gone bankrupt and unlikely ever to pay.
So he lost out on one-and-a-half mil because neither his lawyer, their lawyer or the judge did their jobs? He should sue (while he’s still young)!
